Hi gunank,

To answer your question first you would have to explain whether you got married when he was in the US on his J1 visa or not, or did you get married in India? Have you guys filed for the Adjustment of Status after your marriage?

If not, he will have to go back to India and file for a new visa. (spouse visa probably) In this case you should check whether or not he is subject to the two year rule which means you would have to file for a J1 visa waiver first.

If you tell us more about your situation maybe we could all help you better. Describe where and when you got married and what his status is now. As I understand he would be in the US illegally since his J1 visa expired on July 30th of 2010.

hello murck
He got his J1 visa in June 2009..he is not illegally there..he has a valid ds2019 and he get it renwed everyyear....he is a subject to 2 year HRR....we got married in april 2010..I have valid ds2019 for j2 visa...but my J2 visa has been rejected thrice..so he wants to come india to meet me but problem is his visa was expired in july 2010...so is it possible to get it stamped in USA only and he doesnt need to get through that visa stamping risk...
his residency will end in june 2013..then he will take j1 waiver...

My J1 program visa officer told me that there is a way to get a visa sticker on my passport in the US. She said that she will send my passport and other documents to California. But, it will cost more than I do in the US embassy in my home country and take long time, she said. She did not want me to try this. At that time, my visa was still valid though.

Your husband has valid DS-2019. So, he should get J1 visa sticker safely in the US embassy in his home country.

You husband should contact his J1 program visa officer.

thanks kitten...
this information is going to help me alot...can u tell me more about it...how much time it takes??? and how much it costs?

I do not remember well. I heard these from my visa program officer about 4 years ago.

>how much time it takes???

It was like months. During this time, you do not have your passport with you because you have to submit it to California (maybe different place depend on where you are located) along with other documents. I did not like this idea so I decided not to take this option. (My visa officer also did not like this idea. Maybe it was more troublesome.)

>and how much it costs?[/QUOTE]

I just remember that the price is not too bad cinsidering that I do not need to go to my home country for this visa stamp job and can save the airfare.

Your husband should ask his program visa officer about these.
