J1 Waiver while staying in India

Hello Everyone,

I was in the US for a small time on a 6-month J1 visa from Jan to June 2009. My J1 visa also expired in June 2009. I came back to India after my training and I am in India since then. Now I want to go to the US again on a new J1 visa and have to apply for a waiver for the 2-year home residency rule.

From what I have read, in most of the cases, the waiver was filed from the applicant while in he/she was in US. But as I am in India currently, what is the exact procedure to get the waiver?
Will I too need NORI letter from India and then send them to Indian Consulate in the USA.
Can someone please detail the process to me considering I am currently in India, so that it is clear.

Please do let me know soon as I have to start the process urgently.

You do not have to obtain a waiver to apply for another J-1 visa. The 2-year rule only prevents you from changing your status to H/L/K visa or lawful permanent residence.
I have held three J-1 visas without having to obtain a waiver between each one. I recommend you should apply for a waiver after the start date of your last J-1 visa.
 
Thanks for the reply pk.net. I need one more clarification. In most of the cases people are still in US and they keep taking new J-1 visas. However, in my case I will be requiring a fresh J-1 as my first J-1 has expired and I am currently in India. Do I still do not need a waiver? Sorry for the botheration, but I am in a fix here.

I was in the same situation as you. Each of my J-1 visas is 4-8 months apart. So, I had to get a fresh DS-2019 and J-1 visa stamp three different times.
I was not in the US between each one.
