J1 waiver Job (Please Help)

Hello everybody:

My H1b (J1 waiver) has been approved and I believe INS rules states that I should be on the pay role within 90 days or else my status will be on jeopardy.

My employer is reluctant to give me a starting date for the past 1 & 1/2 months, despite of my best efforts. He has not even started the necessary paper work required for getting me started like health insurance and malpractice insurance. I don't know what to do at this moment. Please help me.

1- Is it possible for me to my H1B JOB on the above basis, even its not started yet.
2- What things I should take care of before proceeding.
3- Any other suggestions for me?

.. a familiar scene. there have many people in this situation before. search the archives of this forum and you will find them. not a dangerous issue.

looks like you might be in for some big issues with this employer in future. so be on lookout for another job.

Do you mean its not wise to change my job ? or the H1B visa?

What I meant to ask that is it possible for me change my job on the basis that it has already been 1 1/2 months and I still don't have any start date in black and white.
 
1) Regarding the 90 days, its upto the state health dept which sponsored you to decide if they want to enforce it. Many people (including myself) were unable to join in the 90 days limit as either our residency/fellowship did not complete or our license/malpractice insurance were pending. I know for a fact that some states, including texas will be contacting your employer within 1 year of your j1 waiver approval to verify that you have joined and you are practicing in underserved area. I also know for a fact that TX doesnt create a fuss if you are unable to join in the 90 day limit due to a valid reason.
2) Regarding looking for a new J1 waiver position, when one has already been approved, I think its risky and to be done only if you are hundered percent sure that prospective employer is not keen on retaining you. My employer also took his time starting my paperwork however every thing clicked by the time i joined. So I suggest communicatinf with your prospective employer and asking him directly if your paperwork will be ready on time.
