For H1b employment you need to be a W-2 employee and that is where the problem lies.
(I know one guy who bought a practice and did his waiver as an employee of his own corporation. In order to keep the goverment of his trail he had to keep a partner in the corp and own his share through a trust. 3 years later he sold the practice and moved on to greener pastures. WARNING: this is in all likelihood illegal).
