J1 Visa question

Hello!

My past employer has recently suggested me the position in US office along with J1 and sponsorship. I was working during 3 years overseas for that company before. I'm an IT specialist from Ukraine. My question is: can I take my wife with me or are there any prohibitive reasons? If so, how can I avoid restrictions and go together with her? Maybe there are some other types of visas letting me take my family with me.

Thanks in advance!

It seems as though the L-1 visa suits your needs the best. L-1 visas are available to a person (and L-2 for spouse/family) to transfer him/her to work in the U.S. for an employer, who he/she has worked abroad for 1 continuous year within past 3 years in a related business entity in a manager/executive capacity. Applicant must be coming to the U.S. to continue providing services for the same employer. Your L-2 spouse will be eligible to apply for work authorization.

You could possibly also obtain a J-1 visa, which is much easier to get than the L-1 visa. Ukraine is not on the skills list so you do not need to worry about the 2-year home residency requirement. If you do obtain a J-1 visa, your family can join you and your spouse can apply for work authorization. That being said, you may be overqualified for a J-1 visa from the facts you have given.

Hope that helps! If you need anymore advice feel free to email me. (info@thevisaexpert.com)
