if employer is not really breaching contract, can j1 waiver still be transferred under extenuating circumstances?
My contract has very careful clever language. I am specialist and have specialty waiver in internal medicine. But my employer forces me to admit internal medicine patients as well as take ER calls for different hospitals which totals about 13 days a months! i see ICU patients and on call every other night for practise. Without residents, the ICU nurses call even for trivial things like K of 3.4! The sleep is always interrupted several times and then next day is busy routine. I am applying for transfer on basis of the fact that i am prone to make serious medical erros due to sleep deprivation and fatigue and that ICU patients are sickest patients whose condition chages by hour and warrants more attention.
