Currently on a J1 but want to transfer to a H1B.
My J1 expires on Oct 2009 (not subject to a 2yr rule)
Can i apply for H1B visa BEFORE my J1B visa expires - and remain in the USA until Sept/OCT 2010 until i know the status of my H1B application.
Or would i have to return home in Oct 2009 when J1 expires.
If this is so, i could return to the USA in Nov 2009 and stay on my 6Month visitor visa (Valid until May 2010) and overstay this whilst my H1B application is being reviewed...
Please share any advice or past experience!
