J1 research to j1 clinical- major issues

j1confusion

Registered Users (C)
I am a doctor from India and i intend to puruse residency in US. i have been offered a research position on j1 for a period of 8 months , and i will be tsarting nov 2007. my reisdency will start june 2008 .

I have the foll queries and i would appreciate if experts opine regd my case

1) since i will not be funded by the US or Indian govt ,I will not be subject to the 2 yr HRR under this clause

2) however, although medical research is not in the required skills list , somehow all doctors from India going for research are subject to the 2 yr HRR. even those who have not received any funding. I do not know why this is the case. can anyone explain why?

3) I have seen varying time taken by the DOS to give advisory opinions regd the 212 (e) clause? what i the time usually taken?

4) If the DOS adviisory opinion states that the clause does not apply to me, can I apply for h1 if I just present that opinion in my petition and get an h1? can i still be subjected to the 2yr hrr? esp in cases where the 2 yr hrr is stamped on my visa?

5) Since I wil be pursuin clinical research, if i apply for change of category from j1 research to j1 clinical for purposes of residency, how time consuming can dat be? and how succesful usually are such cases?

6) Can i apply for change of category even before i am accepted into a residency program ? If i can i wld prefer to apply early since i do not want to lose my residency

7) If the 2 yr HRR is not applicable to me, does this fact hasten the process of conversion from j1 research to j1 clinical?

8) my j1 term will expier on 31 may. However I will be applying for j1 clinical in march, for starting residency in june. So will the ecfmg issue me a fresh DS 2019 or will I just have to petition the DOS for category conversion?

I need expert opinions here. Someone plz reply fast.

Thankyou.
