I am working on J1 for almost 2 yrs by now as a researcher. I did applied for NOC from India ( viz passport office, New Delhi and Home ministry mumbai) out of three i got two soon and third NOC is awaited. As soon as i get this NOC i will apply for H1B. Now here is the confusion, my wife recently completed her degree and want to come here to work as a researcher too, if she come as J2 dependent she can work but very soon i will be applying for H1 and that will take her naturally on H4 which doesnt allow her to work. If she come on independent J1 she also need to apply for waiver which is lenghty and time consuming. Usually for researcher at university J1 visa is offered rather than H1. As soon as I switch on H1 am also planning to apply for I -140 under EB2. I am thinking there must be some way to avoid waiver process for my wife. Please reply if anyone experienced this kind of situation or heard some thing like this.
