J1 HRR-advisory opinion or doing time?

I am an Indian Physician(MBBS).In 2004 August, I went and returned from the USA on a J1 Visa.My subject/ field description was : Psychology/General.My sponsor was New York University.At that time,I was still a medical student and not a qualified physician.However, I was stamped as being 212e applicable by the skill list clause, though the skill for which I went to USA isnt on India's list issued by INS.
In 2005,I went to Japan for 2 months.
In 2006,I have got admission in General Psychology Phd and plan to get the F1 visa for the course which starts in Sep,2006.
Now,these are my queries:
1.Do I have enough ground for advisory opinion on my 212e?
2.If I go to USA on Sep, I will have done 1 year 10 months of my 2 years( subtracting 2 months for Japan).Then, if I return for 15 days every year, that way can I do the remaining 2 months for completing HRR or do I have to start all over again after completing F1 visa period?
3.Or do I go for a J1 HRR waiver application?
Any input is highly appreciated.
