J-2 Visa to H-1 Visa (Can waiver be waived if I go back in India)

Hi,

Currently I am on J-2 visa and my husband has 2 yr HRR. My company is ready to file for my H-1 and then GC but due to HRR, they are helpless.

Is it possible, if I go back to India and then my company files for my H-1? Do I still need 2yr HRR?

Pl. whosoever has faced the same kind of situation, let me know.

As far I know. Principal J1 applicant has to complete 2HRR, why don't you think of applying for 2HRR waiver.
