j-1 visa waiver of 2 year requirement, no objection

Hi, I am writing to ask a question regarding what to expect now that the state department has granted my fiance a favorable recommendation. they said they sent it to uscis but I am not able to get more info from them. Does anyone know what to expect from this point on?

As you just found out, the USCIS will process your case from this point onwards. However, I assume from your post that your fiance is abroad and unable to return pending the waiver? In a week or two you will receive a receipt notice from the USCIS as evidence that they received the waiver recommendation from the State Department. You will also get a copy of the State Department's recommendation. It is actually possible to apply for certain immigration benefits, including a green card, with just that receipt even though the final waiver decision is pending. Some more info about your case may help get some of your questions answered.
 
Hi, here is our situation. My fiance is currently living in Kenya. He was here on a student visa and left in May. We applied for and got a fiance visa but when he went to get the visa, they told him about the j-1 2 year requirement. Unfortunately we were both unaware of it. So we applied for the waiver through the state department, and got a favorable decision for a no objection waiver on friday. now i again wasn't aware that now it has to go through uscis so i am trying to find out if anyone knows how long it might take. I get varying answers but can't seem to find someone who knows for sure. any help would be appreciated.
 
Sorry about your troubles. The reason you get varying answers is because USCIS takes varying times. Some people have gotten theirs in a week or two, and others took a couple of months. If your finace's application went to the Vermont service center, it may be faster. In the past year or two, USCIS adjudications have generally (though not always) been a lot quicker, so you could see yours very soon (just a few more days or weeks). It is not supposed to take more than 8 weeks maximum (60 days) after the USCIS receives the recommendation from DOS. If you receive the DOS recommendation in the mail, your fiance can try to get a visa with just that. Or to be on the safe side, wait until the final approval. Either way, good luck. The hardest part is over, this is just a formality.
