I saw the FAQ and it was nice to know that where its clearly written you guys are not willing to support lawsuit. We don't need your admin or legit approach to solve this issue. You have claimed that you have spoken with the high level official at WH, and they are aware of it. But no one is willing to do anything, everyone is aware aware and aware, no concrete way to resolve the issue.
Put an information there, stating the members and its founders of their green card timeline, let us all see how many people are in backlog mess. The only person who knows others pain are in this big backlog labor mess, for others its just another day to see if their apporach in filing 485 gets on its way.
labordrags,
All of us are frustrated. Let us try to channelize this frustration in a constructive way instead of fighting with each other.
I am a director of IV and my labor is stuck PBEC. My priority date is June 2004. If you want further proof, I can request my screen shot from philly, if that is what is going to convince you. No less than 4 core group members of IV have their labor stuck in BECs. So we do very much know the pain.
As for the lawsuit, Rajiv Khanna has himself said that there is zero chance of it being successful. The only good thing that might come out of it is, we might get some stats and publicity. Given how USCIS stonewalled the previous case with I-485 processing, do we really expect much?
I am not telling the lawsuit is not necessary. Please go ahead with it and it will be complementary to IV's lobbying effort. But IV cannot by itself sue the government. Our lobbyist has clearly told us that no one will be willing to change laws in our favor if we're going to antogonize them by suing.
We have already been able to speak to many people on the administration side and they are very eager for a solution to this problem. Tomorrow we will be speaking to USCIS ombudsman Prakash Khatri who has done a lot of analysis about BECs. At the end of the day none of us, not you not me, have concrete solution to the BECs. So speaking to such people will really help in getting ways to solve it. Since you're aspiring to be a lawyer yourself, do you really expect them to even give us 2 mins of their time, if IV is going to sue them?
I am not sure when your priority date is but for many of us with 2003 and 2004 priority dates, retrogression is likely to be a problem even if labor gets cleared. Also given that there are more than 270,000 I-485's already pending, very soon I-485 processing will take 2 -3 years just like how it was in 2002-2003. Also many of us might get stuck in Name Checking.
So let us all not be shortsighted to think that labor certification is the only problem. We'll have to take a wholistic approach and work on all the delays. That is precisely what Immigration Voice is doing now.
