The May bulletin has proved beyond a doubt that EB3s are not going anywhere this fiscal year (ends Sept 06). My prediction for EB3s is that India will crawl to April or May 01 while the rest of EB3s will not move more than a month or two for the rest of the fiscal year.

Oct 06 may bring some relief to 01 filers but that to is suspect because there is no telling exactly how many 245is are going to be flooding the system then. The best case scenario at this point is that EB3s will move past 01 late this year or early next year. Worst case scenario is that EB3s keep lingering in 01 all the way into early or mid 07.

The above is assuming that no bill is passed in the Congress. This is probably what is going to happen.

Below I have listed a realistic approach based on EB3 PDs - (I have assumed that there will not be any pro immigration bill this year)

Beyond May 2001 PDs - Keep a close eye on the bulletin the next few months and see if there is any movement beyond may. The realistic estimate is that dates for most EB3 categories will not pass May 2001 this fiscal year that ends in Sept 06. There is a glimer of hope beyond Oct 06 but that to depends on a number of factors such as the number of pending 245is.

2002 PDs - Sorry if I sound pessimistic but I think EB3 PDs have very little chance of getting into 02 before early to Mid 07 at best. It might even take longer than that for 2001 to be completed. These people should stay tuned but should not stress about monthly bulletins this year. Try to enjoy what you have and make the most of it ..

2003 PDs and beyond - I think the best thing for now is to keep an eye on things but not get too engrossed in this stuff. If I were in this situation I would concentrate more on immigration reform and trying to get an immigrant bill passed in Congress this year or the next. Checking bulletins this year and stressing about them is a total waste for these PDs at this point in time.
I really do not see EB3 dates getting anywhere near 2003 till 2008.

Based on all this I think all of us need to asses our individual situations and make the best decisions under the current circumstances. This process is seriously affecting our quality of life and this is really harmful. We need to come to terms with reality and make healthy decisions for us and our families.

I completely agree with you saras76. My PD is Nov 2001 and the way EB3 PDs are moving, I don't expect my PD to become current anytime sooner than 2nd quarter of 2007. Forget about getting approved. Approval probably won't happen till the end of the next year. (PD for EB2 now is Jan '03, but TSC is still approving cases from Jan-May '02).

This delay in the PR process has started effecting me personally and professionally. To me, my family is more important than anything else in this world. So I have decided that I will live the life fully with my family, and not fret over this whole screwed up process, because, there is nothing we can do about it.

Plus, even having a current PD is not helping the majority of us. It is just a bloody date that our priority date has become current. If lucky we get approved otherwise wait till the name check , background check and God knows what not goes through.

No point running and prediciting. It will happen when it has to happen and if it has to happen. :)
Tell, then live each day with a smile and pray something happens.

What if the immigration bill is passed. The bill they are talking abt
and the rallies going on right now does it hold good for us too(h1, eads)

If this bill is passed what can we expect?
could u shed some light on that.

I would be lieing if I said that I know exactly how this bill will impact us if it becomes law (a BIG IF). But I can take a guess. Right of the bat the number of Visa numbers will be increased by several thousands. This bill will have an immediate effect on EB3s because the way it is structured, EB3s get the most number of visa increases. There is also a provision whereby dependents don't get counted towards the visa numbers so that will idirectly increase the number of visas in the pool. Taking all this into consideration, this bill will solve the immeidate EB3 backlog problem. I am not sure if the dates will become current but they will defenitely move beyond 01 and well into 02 within a few months of it being passed.

The one thing people are upset about is that this bill puts a hard cap on the number os visas alloted per country. The way things work right now if there are extra visas remaining and if India or China has used up all the alloted visas for them (7000 in a calendar year I believe) then the extras are given to them. So in essence a lot more visas go to India and China than the 7000 cap. This is because there is a provision for redistibuting the unused visa numbers to countires that are oversubscribed. If the bill passes in its current form then there will be a hard cap of 10,000 on China and India and they will not be allowed to take any of the unused visas. The unused visas will be passed down to new categories (EB5 - unskilled workers who will really be the 11 million illegals that will get amnesty through this bill). How exactly this impacts India and China in the long run is anyones guess.

One thing is for sure, things as they stand right now are totally hopeless. Any bill that will add visa numbers will bring immediate relief to 01 and possibly 02 EB3 visa holders and will help get over the 245i hurdle.

The advantage of the bill (if it becomes law) would be:
1. Increase in immigration visa numbers (EB3 category will be benefited most)
2. 1 immigration visa number would be required per family i.e. only primary petitioner will require visa number and dependents would use the same visa number. This will free up the visa numbers for more cases per year.

Disadvantages:
1. There will be a cap on the available visa numbers for each country. If a country uses all the visa numbers for the year, it won't be able to avail the unused visa numbers from the other country's quota.

Oops, by the time I typed in my response, saras76 had already replied. I didn't mean to send out the duplicate info, but I got involved into something else and it took me a while to complete my response.

saras76 you are too good man. You sound very cool and composed even after waiting for so long. I wish I had the patience like you.
