Folks,
I don't mean to sound like a cliche, but I got those magic emails today :D

If you look at my signature, it doesn't seem like a long journey, but in reality, it has been one. :( I am on my 8th year of H1 and that should say a lot. After a few false starts (on the GC journey), I did get lucky in the end.

My sincere thanks to Mr.Khanna and the team that maintains this website. Many thanks to all the contributing members and special thanks to those who have been extremely generous with their wise counsel. I can't think of any specific question /clarification that I might have sought - but simply reading through this forum, day in and day out, for the past few years, has enriched, enlightened and helped me a whole lot. I am too exhausted now (and a little drunk ;) ), to think of all the good guys out there, but United Nations, God bless you, man! If anyone deserves an award for helping fellow-immigrants on this forum, it is you.

I wish all of you who are waiting, the very best of luck. I hope you get your approvals without undue delay.

I don't know how many of you are from India, like I am. I used to get quite annoyed at petrol stations in Madras where the normal practice was to cut the line, push and shove, in order to get ahead. Well, in this adopted country of ours, lines are usually respected much more than they are in India. However, this line to get a GC has not been so orderly. I apologise if I have cut in front of you.

Before I sign off for good, I'll stick around for a while to take any questions you might have.

May I ask you a Q - Have you applied for EAD? Your signature doesnt show EAD details. You must be using H1 extensions.
I am almost at the ending of my 6 yr period which expires April 15. I have EAD and applied for advance parol and do not have plans of travelling abroad until I get my GC or AP. Here are my details:
I dont have many LUDs unlike many others in this forum. I dont know if it is a concern or a good sign. I am in a dilemma whether to apply for H1 ext or not. It is an expensive process. My ND is close to the posted processing date in VSC.

WantGCIn2005, I do have EAD and AP but did not use them. Of course, my wife benefited from getting her EAD. My employer footed the bill for all my immigration applications, including the H1 extensions. That's one reason why I didn't mind having some redundancy. I could have gone on EAD and not applied for H1 8th year extension, but decided to apply (for the H1 extension) anyway. My reasoning was : what if there is a NOID (denial) on I-485 and it takes a month or so to prepare a MTR, etc. I was not sure if I could continue to work on EAD during that period. I was sure though, that I could continue to work on a H1 (till its expiry date).

In short, I had some redundany /fall-back plans, but fortunately didn't need any of those. Also, I didn't spend a cent out of my pocket and so it was an easy decision - to go for all those free goodies ;)

Regarding LUDs, I didn't have any, till I got the approvals yesterday. My last LUD before that was when USCIS received the results of my fingerprint review from FBI (on 4/15/05). I think you are doing fine so far. I got my approval (a little before) 1 month after giving Biometrics. Usually it takes 4 to 7 weeks, if there is no other issue.

Your signature block indicates that no pp is necessary, why is that?

Also, you used biometrics and fp interchangeably, are they the same?

Thank You for your detailed response. In my case 7th year H1 extension is not being sponsored by my employer unlike the other extensions earlier. He is advising me to use EAD. A friend of mine just said like this: 7th year H1 extension is bsed on your labour certification (or green card which in all our cases is I-485) being pending more than 365 days for a decision. It is said by many people and also my lawyer that it is safe to file for H1 ext while I-485 is pending becuase to protect oursleves when there is a denial, but that if I-485 is denied, doesnt it mean that a decision on our greencard application has been made and why should they validate H1 extension in that case? How will they cross check both of these? Is it very easy for them? According to that friend, the chances for H1 approval in case of I-485 denial are very slim or may be even the H1 7th year ext be denied, in which case we'll be ruined. So, I almost decided to take the risk and not go for 7th year ext.
If the employer pays we dont mind..

I think FP and Biometrics are different. We gave Fp and as it appears on the notice as code 1. For Biometrics they collect the Finger prints, digital signature and picture and on the notice it appears as code 3. I think people who are getting biometrics are getting GC directly and need not go for stamping. This is just my understanding. I dont know what is right or wrong.

Thanks for answering my question. do you know if stamping is still an option? I am traveling at the end of June and if approved, the actual card may take some time to process. Any idea?

If the I-485 is denied before a decision on the H1 extension is made by USCIS, then they will also reject the H1 extension application. But if the H1 extension had been approved before a decision on I-485 is made, they will not revoke the H1 in case of I-485 denial. The person can continue to work on the extended H1 while an MTR is prepared and filed. Of course, s/he cannot work beyond the H1 extension's expiration date. Before that, they need to get the MTR in, just to stay in status. If someone had switched to EAD, they cannot do this. With I-485 denial, the EAD also becomes invalid immediately. They could still prepare and file an MTR, but cannot work in the meantime.

I think you stand a very good chance of getting your I-485 approval in a week or two. You probably made the right decision in not going for H1 renewal. I know it is tough till we see the approval. Hang in there!

Our Fingerprint Notice had code 3 and it mentioned the word 'biometrics' as well. Some time ago, there was a good posting on this forum regarding the 3 different codes. I had read it prior to going to the ASC. Like we expected, they took our fingerprints (all fingers), picture and digital signature. We were lucky to have all of it done in 20 minutes or so.

I read (again, on this forum, is it RoaringBull's case?) that some people who got Code 3 and gave biometrics were mailed an approval notice (I-485 approval) with which they had to go for PP stamping. In our case, the approval email and online case status say that the card has been ordered. For my kids, it says that approval notices were mailed.

There seems to be no guarantee (so what else is new with USCIS?) that you will be sent the card directly, even if you had done biometrics code-3. You may still need to do PP stamping. Good luck! I hope you get whatever works for you. BTW, why not take an AP for travel?
