INS\'s Premium
Processing Program
The INS will implement the first phase in its Premium Processing Program on June 1, 2001.
Under the plan, the following types of petitions/applications will be adjudicated within 15 days upon the payment of a $1,000 processing fee:
E-1 Treaty Traders
E-2 Treaty Investors
H-2A Agricultural Workers
H-2B Temporary Workers
H-3 Trainees
L-1 Intracompany Transferees
O-1/O-2 Persons Of Extraordinary Ability
P Athletes And Entertainers
Q International Cultural Exchange Visitors
In July or August 2001, the INS will add the following types of petitions/applications to the Premium Processing Program:
H-1B Professional Workers
R Religious Workers
TN (Trade NAFTA) Professionals
Eventually, permanent visa petitions like form I-140 will be incorporated into the Premium Processing Program.
How The Program Will Work
When an petition/application is submitted to the INS under the Premium Processing Program, the INS will have 15 days to issue one of the following documents:
Notice of Approval
Notice of Intent to Deny
Request for Evidence, or
Notice of Investigation for Fraud or Misrepresentation
The 15-day clock begins to run on the day that the INS physically receives the petition/application, and ends on the day the INS issues one of the above notices or requests. If the INS fails to issue one of the above-referenced notices/requests, the $1,000 fee will be refunded. However, the petition/application will still be processed expeditiously.
How To Participate In The Program
The petition/application must be accompanied by Form I-907, a Request for Premium Processing Service and a separate check for $1,000. If Form I-907 is filed after the petition/application is submitted, the 15 days will begin to run as soon as the INS receives Form I-907 and the $1,000 check. The petitioner/applicant should include a receipt notice issued on Form I-797 for the initial petition/application. The INS will establish a particular P.O. Box number and zip code at each Service Center for the Premium Processing Program.
