Being an open-minded person, I can't see how this case is different from, let's say, coming to the US as a refugee.. Those who are persecuted in their native lands due to the"wrong" political affiliation, religion, or, as in this case, sexual orientation can apply for an asylum in America. The problem arises when this right is abused -- there are hundreds of gifted storytellers coming up with bogus stories of oppression and harassment. As long as the case is genuine and the person NEEDED protection that his country couldn't provide -- I'd say kudos to the immigration officials for correcting the injustice.
