Issues in Birth Certificate

Hello,

I just learnt that my labor got certified last week. I am currently gathering all the documents for I-140/485, and needed some help with both mine and my spouse's birth certificate.

We both have original birth certificates issued from our city of bith. However:

1. My spouse's birth record was automatically transferred from the hospital after the birth (so it was registered the same month) - however, my spouse's mother was admitted using her pet name (not the name registered in my spouse's passport, instead its the name everyone at home called her by). This is what shows up in the birth certificate. So now we have a computer-generated birth certificate (issued last month), and the officials at the health department have handwritten in brackets alias Real Name - so right now, under Mother's name there is HomeName Lname (alias RealFname Lname). The change has been stamped and signed by the officials.

2. I was born in a private hospital - so I have the original hospital record. Apparently, in my city only government hospitals automatically transfer birth records - for private hospitals, the parents have to personally go and register the birth, and can only do so just before the child enters school, so no earlier than 3 and 1/2 years after the birth. So I have an original birth certificate issued four years after my birth (hand written information). I asked for a new computer printout, and they gave me one - but mis-spelt my name! I pointed this out to them, and they struck out the printed name by hand, changed it, and then stamped and signed the change!

So my question is - will these birth certificate work? Will I need any additional affadavits? I heard somewhere that the birth certificate must have been issued at most a year after birth, if not, additional affadavits are needed - is this true?

Any help will be most appreciated. Thanks!

If you are from India - lower counrt term applies for this post, else your relevant authority:

Get an affidavit from lower court against her your mother-in-law's declaration.

This will be a cause of concern to prove when was it stamped and why was not duplicate generated! Get a new one with right name. Also get an affidavit as it is more than a year old. (Your parents can do that for you.)

Hi Jharkhandi,

Good to see you in 140 forum.. My LC is about to be processed(positively I guess !!) and I jumped in this forum to save me some time later.
I'm expecting my LC to be done in the next 2 weeks.

Could you tell what should I do to be ready with the docs when LC is done and save some time?

Secondly, I have a question on My wife's father's name...
Her father's name
On her passport : <Fname> <Lname>
On marriage certificate: <Fname> Kumar <Lname>
On her Birth certificate: <Fname> Kumar <Lname>
We have another document from court with the birth certificate, which says that
<Fname> Kumar <Lname> is corrected to <Fname> <Lname>

Same is the case with her mother's name.

I know the situation is complicated. Now the end result is :
The names on the passport and birth certificate(after correction) match, but the name on marriage certificate is still having the middle name.
Since it is customary to have 'Kumar' as the middle name in our part of the country, can I do something to satisfy USCIS in this case?

Thanks a lot.... And dont forget to advise on what should i be ready with .......

Thanks
