I am on a H1 with Company A. My H1 got approved a few weeks back and the company is having the Original Approval Form (Form I -797) and also the original I-94.
I have a question.
1. If my employer does not give me those original documents, can i legally ask him to give me without affecting my status.
2. If i dont want to go legal and get all the pain....Can i apply for an H1 through another employer. an H1 Transfer.
I came to know that you just need copies of H1 approval and ur I-94 to apply for Transfer. I have proper Pay stubs.
3. Say i apply for H1 transfer and get my H1 approved from COmpany B. Will the second H1 also contain the I-94. ???.
i would be very grateful if someone could answer me this.
