Issue regarding Selective Service Registration

Hello Guys,

Hopefully somebody on this forum can help me out with Selective service issue. According to N-400, if you are in US between 18 to 26 on any status except for Non immigrant, you need to register for selective service.

i was not aware of such rule, but anyway, it is too late as i have already applied for N-400, and i am 28 years old. I came to USA on F1 visa, later on converted into H1B, and just 9 days before my 26th birthday, i had green card interview, and later on granted greencard. Can i argue on the bases of that i was granted green card 9 days before my 26th birthday, and that is why i have not registered ? My green card arrived later on (after my 26th birthday) with starting date 9 days before my 26th birthday. Can i argue on the bases of that ? Although, in the interview officer told me, my case has been approved.

I have already asked selective service regarding this and asked them status information letter. Does anybody went through similar situation where selective service considered their case and gave exemption. Please let me know if it happened with somebody

You should be fine. I doubt the USCIS will make a big deal out of this. In my opinion, it will depend on the type of officer you will get at the interview. Since you already applied, it might be worth bringing a written statement to the interview to explain the situation.

Even if the interviewer says you are approved, that doesn't mean you get permanent resident status right then and there, unless they actually give you an approval notice on the spot or stamp your passport. There may be additional paperwork required to finalize your case, so passing the interview doesn't mean anything by itself. Sometimes people have a successful interview and they still wait months to get the final approval on paper or card (and the card is dated after the interview).

So if they didn't stamp your passport or give you anything else in writing at the interview, I think you have a good argument for saying your failure to register was not willful, because you didn't find out you actually became a permanent resident until after your 26th birthday.
