Issue of GC while Derivative is outside

Hey all,

My wife has travelled to India on H4 also possess AP with Her..

What IF the derivative applicant gets approved meanwhile ..
How can she enter U.S ..( I mean H4 or AP )

1) WOULD LIKE TO GO AND BRING HER ....
2) wHAT DO i SHOW AT THE PORT OF ENTRY AFTER THE APPROVAL ..WHILE APPROVING SHE IS OUTSIDE..

Can I Maintain the H1 Status and bring her on H4 or show the Advance PArole

Please Advice.....

If your 485 is approved while you are out, the only way to come in is via AP since 485 approval automatically invalidates the H visas. When you come in they will tell you at the port of entry that your 485 is approved and you have to visit a USCIS center with next 15 days to validate your stay and get a stamp.

There is noting to worry about this situation as long as you have a valid AP.
