I am seeing the trend that people who applied for I-485 alongwith or after their I-140 was submitted are getting I-140 approvals.

Can anyone verify / certify this?

Reason I want to know is this:

I filed I-140 on May 24, 2002. No approval recd. yet.
(checked desired consular processing in I-140)

If I will file I-485, hopefully my I-140 will get approved.
After that, I will convert my case to Consular processing.


Anybody see any problem with this approach?

Please discuss freely.

1. Only people who filed 140/485 TOGETHER seems to have gotten immediate approvals. I filed 485 with 140 receipt (May 23), no response yet.

2. My lawyer had told me that changing from CP option to 485 option is easier, but the other way round is not easy. You will have to file more paper work for that and that causes additional delay.

I would say, if you want to stay with CP option, don't do anything. If you don't care for CP, then file 485/EAD and don't hold your breath.
 
deeone, when did you file ur I-485?

it appears to me that filing the I-485 may cause them to take a look at my I-140 file....and since it would come up from under the pile, it will be processed since it is aready lying on the table.

I am just trying to simulate what might happen in the INS office....

Good luck simulating the work process at INS. :)

I filed for 485/EAD on Sept 3. They might have looked at my 140 file to approve my EAD (Oct 10), but they probably put the 140 file back to the END of the pile, so here I am, still waiting. :(
