Hi Guys,
This is what I heard from my Cousine's lawyer. Their RFE was replied on 12/3 and 12/9(EB2/VSC). When lawyer called this is what BCIS told them on 3/29/2004..

"We did speak to the CIS Director yesterday and found out that the I-140 is still pending and under review for your Cousine B, however, we believe that the I-140 has been approved for your cousine A. A notice of this we'll receive in 30 days.
We spoke to two Directors. The first one indicated that your cousine A's was approved, the second one said he could not provide this info to me and to wait for the notice. We'll again press for answers for Cousine B's I-140"

When I check on line status, I keep getting that stupid message for both of them "your RFE responce.........". Lawyer has not gotton any notice yet. It has been more than 4 months since BCIS received their RFE reply. Please shed some light on this as I feel that BCIS is just ignoring our cases as I see approvals of 6/2003 whereas these cases were filed by Feb. 2003.

Regards,

Below are my responses from what I could make out from your message.

Customer service representatives giving incorrect info is not uncommon. The online message is more reliable. The best is to wait 30 days for the notice.

CIS do not send notice for RFE responses, only the online message changes.

If the case has not been approved after 60 days of receiving the RFE response, the lawyer can call the CIS and initiate a referral.

As per CIS is ignoring your cases, you are not alone, we all feel the same.

EB2 RFE on 140 received in September 2003, responded and RD date per the online message is October 29,2003. Still waiting for teh approval on I140

As you can see, lawyer tried but got the different answers from two people. I'll only believe once I see online status changing. I see people from 7/2003 getting(happy for them!!) but this is not F*****G fair for BCIS to just ignore cases which were applied way before and responded to their query on time. Only God can help us from this mayhem and excruciating wait!!!
