Is this true about status enquiry, my Attorney says

Hi All,

A little background, EB2, NSC, I485 ND Jan 2003, on 5/26/2005 my attorney made an enquiry (as the current processing times is more than 30 days at that time ) and my online status updated with same about the enquiry made and in one week I received a letter saying " due pending security ......" recently I received FP code 3 for 8/4/05( FP code 1 done in 3/2003), but we gave them earlier on 7/18, LUD changed to 7/19( earlier it was 5/26/2005,earlier to that it was 3/2003)) with no change in the wording.

I have been trying to know the status from past 2 months thru the phone almost every day, and I hear "due to technical problem your status cannot be known ...." I told about the same to my attorney and he said keep trying and recently he said the below, Is it true?

A case must meet all three of the below qualifications for it to be eligible for a status inquiry:

1. The current processing date that the service center posts must be more
than 30 days past your receipt date

2. The applicant must not have received any updates, mail, notices, etc. on
their case in the last 60 days

3. The applicant's priority date must be current

If this is true, how every one in the forum is able to know their status by calling the 1-800-375-5283, even if most of their cases do not fall in the above 1 and 2?

what your attorney said is true. All these conditions are not necessary if the inquire is made by senator/congressman.
calling 1-800-375-5283 is not the same as making an inquire. It is just automated system that tells you your case status. Usually it is the same status that you can see on the web https://egov.immigration.gov/cris/jsps/login.jsp
If you speak to customer service rep and ask him/her to initiate an inquire they will probably refuse if the conditions you have mentioned are not satisfied.
It is not uncommon that phone system cannot find your case status. It happened to me for about 8 months. then it was fixed and i could hear status again.

Dima, how was the problem fixed? Did you call/write to USCIS and ask to fix? Thanx.
 
no I didn't do anything
i didn't worry about phone system since I could still see my status on the web
 
How can I ?

All I want is to talk to a live customer service representative or an Immigration officer now, Can I do It in my present situation?

chepyala, don't worry about the phone message. What your lawyer and dima66a said are true. If you want to talk to the rep, pick up any case number you have filed before, and follow the same dialing sequence. It really doesn't help by calling the 1800 number. Actually you are close to get approval. Good luck!

My case is pending due to security clearance actually , the only hope I have about my approval is close is because recently I have received the FP code 3 and after submitting them the LUD changed ,I am hoping that the name check and security check is cleared.

Called USCIS today. The lady said my case is in progress and I should call back after 30 days since they are still processing Nov. 1 2003 cases. Her processing date is old, and she does not know anything more than the web site says. What a useless service USCIS provides.
