Hey hardon, J-1 victum and others, I am US medical student currently on an F-1 with have a OPT for my intern year. I also have a intrested employer who is willing to sponsor me for LC/H-1 as needed. My question is how can I best utilize my employer in this situation. Is it possible for my potential employer to file for a H-1 in my intern year and subcontract me to the residency programs inorder to circumvent the J-1 visa issues, much like consulting compainies do for contractor worker jobs in software. Secondly, how long does it take to get a full liscence processed which I will prob need for the h-1 sponsorship, if I take my step3 and paperwork together early on. Thanks!

Wouldn't bank on it. I doubt that the hospital would take this kind of 'borrowed labor'. There are issues with malpractice coverage and administrative lethargy that would probably derail any such plan. I have heard of people who did their residency while on staff of their uncles saudi oil company without drawing a salary from the residency program. But I don't know what visa construct they chose (maybe L1).
Try to find a residency that sponsors you for H1b. As a US medical graduate, you will have far more interest from the programs than your usual FMG. If you are not planning on going into a highly competitive specialty such as ortho or neurosurg, you should be able to shop for hospitals willing to sponsor H1b. Don't get discouraged by 'no H1b' messages on their website. You are in a different league in that regard. Also, many hospitals are exempt from the cap, even though you are a US grad and eligible for one of the extra 20.000 H1bs, you might run into quota issues.
