My lawyer has just told me that he could apply for EB-3 for me. I have H2B visa valid until November 12,2005.
He said something what I really do not understand : If he files the PERM petition -> it will take max. 60 days to get approval -> during these 60 days my visa must be valid; after he gets an approval form DOL he can file I-140 & I-485 & I-765 & I-131 TOGETHER and - even if it takes a few years to get a Green Card - I will be legally in the USA, because I-485 will be pending.
For me it sounds like a joke. How is it possible to be legally if my visa will expire? Will I have any problems to get GC later?
But the most important for me is if that is the truth that he can file I-140 & I-485 TOGETHER. Everyone says the visas numbers must be current and then I can file I-485 and even if I file I-485 I must be ALL THE TIME LEGALLY if I want to get a GC?
