Hi guys/ gurus,
I was just wondering if this situation is possible as i have read on one website that it was done particularly in one case and i am sure there might be lots out there in this situation.
Well, my grandpa petitioned for my mom, me and my sis for greencard and the priority date is about to become current for Jan 20, 1999 cases (soon).
So the situation is that me and my sister have both aged out in that petition and it doesn't seem that CSPA would work on our case. Now the question is that if my mom gets her greencard through that petition and files an I-130 for us immediately after obtaining her greencard, then can we retain the priority date of my grandpa's petition.
Again like i said, it was particularly implemented in on case Maria T. Garcia Case June 16, 2006.(http://www.visalaw.com/06oct2/5oct206.html). I have the copy of the case if anyone would like to review it.
Please anyone help me out with this if you have any information.
