Is this Normal ?

My I 140 application was approved on June 23 2003 from the Vermont Service center. Filed under EB2 category. I have opted for CP at Bombay consulate and had mentioned that on my 140 application.

Is it normal to not have the case registered at National Visa Center.

How long does it take to get the case number assigned.

I fear that my application is considered as AOS. :eek:

Answer: It takes about 2-3 weeks after I-140 approval for NVC to receive your file and create a new case number

I fear that my application is considered as AOS.
Answer: If you had intimated CP on I-140 application and BCIS has made a mistake and changed it to AOS, then your attorneys can call BCIS and have them rectify. This has happened in the past and BCIS has rectified the error.

You need not wait another week. Check your status with NVC today (if possible, talk to their representative). If they have not received your file, then call your attorney.

My I-140 was approved on 25th June 2003. NVC created my case on 8th July 2003.

I spoke to NVC immigration officer regarding my case and she mentioned that it could take upto 90 days to receive the application from Vermont service center.

Well when I spoke to my lawyer he mentioned that we need to wait atleast a month before he can even investigate.

At the same token he told me to apply for the Police Clearance Certificate.
 
call up BCIS next week and talk to somebody from your service center to find out if your I-140 is already sent or not. My I-140 got stuck at TSC for 3 months because the officer left for another project without forwarding the file to mail room. They couldnt do anything until he came back. So check with the service center.
 
The same kind of situation happened with me . I applied for CP and got approved for AOS. Check with your attorney if the approval notice for I-140 says that the file is being sent to NVC. My approval notice said that I-140 has been approved for AOS and never mentioned that the file is being sent to NVC which was basically a mistake at BCIS end.
If this is not the case then your file should have reached NVC by now.

Dude you are so right. I spoke with my attorney today and he mentioned that the case was sent for AOS inspite of mentioning CP while filing I140.

He told me to wait for NVC reply to make the changes to the application. I proposed to him to go for AC140 route. He is little apprehensive about it and wants to wait for NVC response.

What did you opt for....

Well my attorney wrote to the BCIS for their mistake again and again and finally they approved a new I-140 after 45 days , and now I am going in for the CP. There is one more thread on this CP forum which says BCIS messed up with my I-140 and one of us there was going in for AC-140 for this reason . It all depends upon the attorney.
Well I do not think that NVC will entertain your case unless they receive the new approved I-140 from BCIS . My attorney wrote to them previously mentioning the case but they never replied.
I would suggest you to pressure your attorney and your company to write to BCIS and notify them of this error ASAP or if you could convince your attorney for AC-140 then that should also work as it is my understanding that this is kind of hardship with none of our fault .
