Is this H1 out of status ?

I am about to file my 140 and am in the process of getting employment letters.

I am currently working for company B, and was laid off from prev company A

in Jan 2002.

Now when i got exp. letter from company A they state my termination date on jan 29,02 but when i looked at my h1 approval for company B it says approval date feb 27,02 and receipt date mar 2,02.

I was told by my company A that i have until end of feb,02 to find new employer and my company B filed in first/second week feb and i started working before receiving receipt #

Do you think i should be concerned about anything..

Do not worry about the experience letter. Put your experience in terms of month e.g

From Jan -2001 to Jan -2003 company A
From Feb -2003 to till date Company B.

but my company a mentioned dates in the employment letter and its a big investment bank and i can't ask them to only mention month

Can you ask your current company to show employment only after the receipt date?

It is ok if you are out of status for less than 180 days.

my current company B's H1 approval date is feb 27,02 and receipt date mar2,02

so on my labor i mentioned periods of employment
for company B feb02-present

and for company A dec,00-jan 02

also to use this out of status for <180 days, is there not any date restriction that your labor or 140 be filed by such date

You don't have to do anything to "use" this law. You are ok. Don't worry. But make sure that you don't show that you were paid during the time your h1 was not approved. Out of status residence < 180 is one thing and it is ok but unauthorized work is not ok.
