i left school in June '99 (didn't finish) but school granted me practical training for the summer as they considered me student until the beginning of the new school year. but they say my F-1 will expire upon the beginning of the new school year.
i moved to CA in June '99 and found a job for the summer. employment for the summer was based on the practical training.
i managed to impressed my employer and they applied for H1-B for me. however, i had to suspend my work from August '99 to December '99 while i waited for the H1-B approval. i stayed in the country throughout that period.
since then i have had H1-B until this year where i applied for AOS via my USC wife. application was filed end of April and i have received my AP but no EAD yet.
with the talk of out of status, i wonder if i was consider OoS during the period of August->December '99 while i waited for my H1-B?
my 6 years H1-B expires early this december and i plan to travel outside the country at the end of december for a few weeks. i want to make sure that they will not stop me at the immigration or at any later point in the AOS process.
