Hi Everyone!!!
I am trying to avoid changing status of my B2 to H1B visa since I hear it can jeopordize my future application for B1/B2 renewal.
I arrived in US just last week on B2 and a mortgage company plans to petition me, paperwork will take 1 month.
1. If I dont wait the ideal 60 days before filing for H1B, is this considered change of status?
2. If I leave the US and fly to my homecountry BEFORE the lawyer actually files the H1B petitions so that I am outside the US when USCIS gets them, is that considered change of status?
3. Assuming an approval is recieved via premium processing within 15 days, then, can i come back to US on B2 for touring purposes (not employment)? Then again fly back to my homecountry for H1B stamping 2 months later?
Appreciate any help!
THANKS
