Guys,

I did the currently filling in TSC ( I-485 RD 07/23/2004, ND 07/26/2004) No FP yet.

I just got a letter for TSC today saying
" This is to advise you that in order to speed processing we have transferred the above case to the following INS office for process:
U.S. INS, POX box #7126, Chicago, IL 60680-7126 ...."

But when I check my online status, I find the following
"On September 9, 2004, we transferred your I485 Application to Register Permanent Residence or to Adjust Status to an office in MISSOURI SERVICE CENTER for processing. Our office in MISSOURI SERVICE CENTER will send you a written decision as soon as processing is complete. "

My question is which statement is correct? According to INS website, the MISSOURI office in Kentucky is processing I485 for April 2004. Does this mean my case will be processed soon?

My concurrent 140-485 case with ND of 03/25/04 was trasnferred in July to an office in Miami. I am from ATL GA and the notice said that to "speed up processing" we are tranferring the case to an office in Miami. It has now been almost 4 months since the transfer and I have not heard back from Miami or from TSC. Mine is a straight forward case. I have not changed jobs or moved anywhere. Have been in ATL all along.

Have you had any luck finding out details about your transfer. Let me know. It will be a good idea to keep eachother posted on the progress of our cases.

Just wondering

Just wondering on what basis and what condition the cases are getting
transferred to regional offcies (like Miami or Chicago)? Is that based
on the city/state you belong to? Or is it based on nationality?

I live in DFW area and my work place is in DFW. Is there a chance that
my case may get transferred to any other regional office?

There really is no logic

From my experience I have seen two types of transfers.

First Type - This is a transfer that occurs after the 140 has been approved, FP has been done and the 485s get transferred to a local office near the primary applicants place of residence. The transfer notices sent by the Serice centers usually state that the case has been transferred in order to conduct an interview. Depending on the local office work load, interviews are conducted and the application is approved.

Second Type - This type of transfer involves the concurrently filed 140 and 485 application to be transferred to a random local office. I am not sure if this is due to an error or the Service Centers have started doing this as part of their plan to reduce backlogs. Most of these transfer notices do not mention interviews and state that "to speed up processing" we have transferred the application to a local disctrict office. I have not seen to many of these types of transfers. My case is of this type. It has been trasnferred to a local office in Miami. As stated earlier, I am not entirely sure if this has been done intentionally or is an error on the part of the TSC. I am still trying to find this out. It is extremely hard to get any sort of information from the local offices. They insist on a personal visit and if you are hundreds of miles away like myself, it is not easy. I have written several letters to the Miami office and to the TSC and am awaiting a reply. Hopefully someone will reply.

As for your case being transferred. I wouldn't worry about it to much. Infact I hope you do not end up like the rest of us transferred people. Its a pain.

Thanks for your input saras76. I guess, as long as I don't move, I should
be safe (safe as in my case doesn't get transferred elsewhere).

Well, I would need real good luck not get into this "black hole" - if you will - of
the whole transfer thingy.

I guess I have a long way to start worrying about my case status, anyway :)

Well, I take it back now. I just got a bunch of emails from USCIS that
my case has been transferred to Dallas, TX, office for schedule of
interview, although the scheduling will take months.

Just wondering what kind of info they would need in this type of cases? Did
anybody go to interviews at Dallas, TX, before? Any input from gurus will
be greatly appreciated.

Below is the latest on my case. This was my reply to someone whose case is very similar to mine. Please note that in my case the 140/485 was transferred to a wrong office.

It appears that both our cases were transferred to local offices by mistake. My case sat in Miami for 4 months before I raised hell with my lawyers and got them to start an inquiry through AILA (American Immigration Lawyers Association). AILA has a liasion within the TSC that responds and acts on inquires that are sent his/her way by AILA. My lawyer sent a couple of inquiries through AILA and in November she got an email from someone in AILA that my case is being recalled to Texas. I did not get any official notification of this recall (infact the online status still says that the cases were transferred to Miami on the 16th of July) but on the 9th of Dec 04 the LUD on my approved AP changed for a couple of days and then finally on the 3rd of Jan I received FP notices from TSC. This leads me to believe that my case is back at TSC and they are now processing it. The delay caused by the transfer has added more time to this stupid process. I have also gotten authorization from my company to start a congressional inquiry into my case if nothing happens after FP. The bottom line is that I still have no idea where my case is. Everything is an assumption.

I suggest you do the following -

1. Ask your lawyer to start an AILA inquiry. They should know how to do that.

2. Try to convince your company to start a congressional inquiry and if they are unwilling to do so then you write a personal letter to the Congressman in your area. You can refer to my case as an example of how these people are making so many errors. In the letter emphasize that you feel that the case is in the wrong district, that 140s are not supposed to be transferred to local offices and that no one is giving you any updates on the location and status of your case.

3. If all else fails then make an INFOPASS appointment and go to the local Buffalo office.

I am pretty sure your case should not be where it is. Even if it was sent to the local office in Buffalo for a reason, TSC or the local office should let you know why or atleast get in touch with you after a few months of transfer. The inquires should answer those questions. I hope your case gets back to TSC.
