Is there nothing we can do ?

Hi All,

I finally got through to a human on the CA DOL. She didnt have much to say other than that CA processes applications from 8 states and that is why it is taking a lot of time. But hasnt CA been processing 8 states since the beginning ? Just a couple of years ago it took them far lesser time to process the same (if not more) number of applciations. Other DOLs have also slowed down but not as badly as CA.

Is there really nothing we can do about this other than sign passive petitions ? If nothing else, we are entitled to the truth.

Hang on a minute....

It is my understanding that CA has only recently been handling regional applications that used to be dealt with at the Seattle office in Washington.

Once the Seattle shut down a think about a year ago, maybe less I WAS TOLD that there shouldn't be any delays and that a separate queue (office) was set up in the same building that would keep CA and WA queues completely separate.


Now you are getting me worried. WA times have gone to a virtual standstill. Why I ask myself, because the CA office is on strike or what???

Guys think about this! The SF DOL moving
slower is affecting us in many ways.

Say tomorrow I get laid off it will be really
difficult for me to find another employer who
is willing to sponsor an H-1 for me. On the
same token any person who has an LCA
approved from states like Michigan,
Massachusets (it takes approximately 8-12
months to get your LCA approved here.)
and has passed the 180 day limit to qualify
for the AC-21 portablitly will surely stand
a better chance. Where as we are still
waiting for our LCA's to get approved because the DOL would not process it under the pretext of soft economy claiming that it just takes too long to process some cases. This is ridiculous!!

Why are we being made to pay up for the mess SF DOL has landed itself in ? Again, CA is not the only state that is been having layoff's?

That's why we requested Mr Khanna to write a petition on our behalf and find out what is happening with DOL. But even that wouldn't do much.
I have been in waiting for 1.5 years for my LC and I am not sure how long my company would keep me, I have, thanks to almighty, survived 2 rounds of serious layoffs. I think I would be ok for next 6 months or so at least, but at the current rate I am not sure how long would DOL take to approve/deny my case. What is even worse is that they eventually deny my case, if that happens not only have they wasted 2 years of waiting time but also made sure that I won't have time to apply for a new labor again from anywhere else.
But is there anything we can do? not many options we have.
Having worked hard in this country for last 5 years, and not reaching anywher is very frustrating.
If they could just inform us why they are not processing the cases or when will they start processing the cases that would give us some hope.

I am not aware of the reasons behind the slowdown in the CA DOL LCA processing. I do not know the exact number of states that CA used to process before, but it is common knowledge that CA has always had more volume than any other center. Even if WA cases are being handled by CA now, that doesnt explain a standstill does it ? It could explain a slowdown. Noone knows (myself included) why there is a standstill in the CA DOL LCA processing. Everyone's just taking a guess.

All I'm saying is that a slowdown is understandable, but a standstill is not. Having to call DOL for months before we get to speak to a person and then to have them give us the same explaination of too many applications isnt fair. We need to know whats going on so we can plan our lives better. Right now most of us are just playing a waiting game that doesnt have a timeframe while applications from other centers are progressing reasonably well. Like vasu_c pointed out there are many implications to this waiting game than the DOL cares to admit. It has ramifications on our lives and we all have a right to know why we are waiting and if it is worth the wait. It would be nice to do something about it.

Any idea what happened to the petition on immigration.com and if it has been filed ?

What else can we do ?

Supposedly we have to wait till February
25th before the petition is filed.

I posted a message on the California tracking
list yesterday and was made aware of this
by "lcauser". It is mentioned somewhere on
the petition.
