Is there enough time to file PERM-HELP

Hi

My 6 yrs H1 visa expires April 2007 and my company lawyer is taking his own sweet time to get everything ready to file for PERM even though he knows my predicament, do I have enough time to make it so that I can apply for 7th year extension based on 365 days pending? How much time does the entire process upto filing take?
I would really appreciate your opinions or ideas?(any ideas on how to deal with the lawyer would be great too!!)
 
In the meantime you can also try to recapture the time you spent outside of the US while you were on H1. That will help you extend your deadline beyond April 2007

Just take 2 months vacation next christmas :) You will be fine.

The process :
- X days for lawyer to collect document from YOU and your employer
- 1 - 7 days to prepare for the ad to post on site (this is a starting point).
Option 1: FAST if your lawyer or you company has PWD from someone who they applied PERM before and has the same job/requirement like yours. They can use that PWD to start the AD in parallel.
- 30 days for AD. (also need to submit for PWD)
- 30 quiet period.
Assume after 60 days, your lawyer receive the PWD for you (not right if you are in east coast big cities)
Then, now fill out the online application and submit it (take 1 - 14 days depend on how busy your employer and lawyer)
So, Option 1 takes around 62 days to 81 days.

Option 2: they don't know about the PWD and don't want to waste money and time.
- Apply for PWD first (take around 6-8 weeks, sometimes more than 10 weeks in some areas).
- 30 days for AD
- 30 quiet period
- 1 -14 days to submit the application.
So, option 2 takes around 100 days - 130 days.

The question is WHY you apply for PERM TOO LATE :) Don't expect your lawyer to do your application faster than others. They got paid the same for all applications, so they MUST treat them the same.

It's a long story, I just changed my job , previous employer had policy of not filing for GC, the GC co-ordinator at my current employer is a total moron,
I have been at him since October to file, he comes up with something or the other and has been delaying it and now he tells me that he can't guarantee that they can file before April 2006(only if he got off his chair and actually did something!!!)
