Our attorney has filed my I-140 under EB2 category on Nov 19, 2004 and still it is pending with USCIS, California Centre. I have inquired once for my I-485, and I got a reply from them stating that it is pending with FBI for Name Check. I asked my attorney thro my HR to expedite the I-140 process. Here is the answer from our attorney. If this is the answer, what is the remedy for this type of issue? Thanks
"Unfortunately, there is no expedite of an I-140 petition. We have filed several inquiries with US CIS on the I-140, and have even gone to our CIS Liaison Committee. We are told it is with an officer. We continue to check on the status and will let you know as soon as it is adjudicated"
