Is there any issue if 140 filed, 2 times in CSC

Is any body in the same boat. I recently got my labour certified (after 2 and 1/2 years) from california . Previously in July' 2003 my employer filed a I-140 (alone) using subs. labour in EB3 Category.

Now I asked my employer to revoke that one and file using my own labour ( 140 + 485). I just send all the papaer work for that

When I asked with my lawyer , did they revoked the previous one. They replied they don't know, if your employer should have asked we might have done that.

On online status check, if I give Old I-140 WAC number it still show it (though not approved). I am wondering is that revoked or not. If not is there any issue ???

Do I need to bug my empyer to revoke the previous one.

Can anybody has similar experince or give me a proper advice.

I don't think there's anything prohibiting you from having two I-140 applications.

You can have only one I-485, which is not a problem for you.

I've read people eslewhere (on this portal) speak about applying for CP with one I-140 and AOS with another.

There's a posting at BCIS specifying that one cannot have CP and 485 going on in parallel (which would seem to imply you can have two 140's)
 
I guess I just voiced the "popular opinion", that you don't apply for second I-485.

But you're right -- I cannot find any reason or statement that says cannot have multiple 485s.

Anybody has any more conclusive info?

You may file as many 485s as you want.
