Is there a way - I-140

United Nations/Folks,

I have been waiting for my I-140/485 after filing with copy of
a substitute labor. Received a RFE for company financials in NOV.2004 and responded in Nov. itself.

Seeing all the delays for substitute, I am exploring any other possibilities.

In my previous company before I was layed off, I had my Labor and I-140
approved. However I was layed off before applying for I-485. Is there any
way I could try to reuse my previous I-140 with my current employer.

PLEASE ADVICE.

Thanks

United Nations,

Thanks a bunch for your detailed response.

My only problem is my I-140/485 was applied with a copy of the labor.
Hopefully the previous candidate did not opt for counseler processing.
I will find out.

I do not have "ability to pay" or Education Issues. Mine was applied under Eb-2. I did get a RFE for the ability to pay and it was responded immediately in Nov.2004. Multiple email queries by my attorney to USCIS hasn't resulted in any response from them.

Thanks for your suggestion on the reuse of a already approved I-140.

I have the I-140 approved when I was working with company X.
Before applying for I-485, I lost my job. That company is now bought by another company.

I will explore the possibilities and please feel free to give me your expert advice.

Regards
longrunner
