Is that ok to work om hourly basis

Guys,
After completing 180 days I got laidoff and now I am working on hourly basis (W-2), in case on RFE if my employer provides me a letter stating that I am earning X$/hour and working 40 hour a week having the same job responsibilties as with Labor, will that be OK with INS

And one question, I want to add...will the size of the company matters in AC 21 apart from working on W2.

But isn't it that your job needs to be permanent in nature ?

If not why are we adding in the employment letter that our job is permanent?

You must be kiddin'. No job in corporate America is 'permanent'. Working on W-2 hourly basis should be fine.
