Is stamping necessary after 485 approval for my kid

Hi

We both (Me and my spouse) got an approval letter from USCIS. But my son got a welcome notice followed by Permanent resident card dated Dec 1, 2004. We are now planning to take an info pass appointment.

Right now my son is in India. He has a valid H4 till June 2005. Please clarify my following doubts

1. Do I have to take my son along with us and get his passport stamped?
2. Can we get our passports stamped and get him from India after we receive plastic card?
3. Is there any time limit in his case to be in US?

No...not required for kids.

I guess you mean once you get your plastic card, you will go to India and get him right - yes you can

3. Is there any time limit in his case to be in US?
The only issue I see here is that his H4 is no longer valid (as it is based on your H1) and he cannot enter based on that. But as you have his GC I guess when you go get him, you will be carrying his GC and should be fine. In other cases once the 485 is apporved, a person can enter only on AP.

Thanks Dharma for your quick response. Your answers are quite convincing and reasonable. I will try to cross confirm with my lawyer and USCIS. One final question

1. At the port of entry while retuning from India to US which is period will be taken into consideration, Is it from the period he left to India (Nov 30th 2003) when he was on H4 or from the date he was issued a green card (Dec 1 2004)?

Please provide us with your thoughts.
