Hi, My wife is currently pregnant and plans to go on maternity(unpaid) leave soon. She was thinking of availing Temporary Disability Insurance & Family Leave Insurance from New Jersey state.
Please clarify if this is considered a public charge & whether it would affect our Green card process? I am on H1B visa & she has a H4 EAD. Thank you

Wondering if NJ Temporary Disability Insurance could impact immigration status as a public charge. It's essential to understand how government benefits affect immigration status and seek guidance from legal experts or immigration authorities to ensure compliance and avoid potential consequences.

Temporary Disability Insurance (TDI) and Family Leave Insurance (FLI) from New Jersey are state-funded programs that provide financial assistance, and using them does not count as a public charge under current guidelines. These programs should not affect your green card application process. Since your wife is on H4 EAD, her eligibility for these benefits is not an issue for immigration purposes, and it should not impact your application for a green card. However, it's always a good idea to consult an immigration lawyer for personalized advice.
