Is my background check late?

Dear friends,
I would appreciate it if somebody could give me some advice.
Summary of my case:
Case number current in Feb 2006
FP done on Mar 31th
Interview done on Apr 24th
The interviewer said that the results of background check of my wife
and child were in, but mine was not, and everything else was ok.
Now I have two questions:
1) Can I consider the results of my background check as late?
2) If I want to follow it up, what can I do? Is it going to be helpful
if I make an infopass appointment? In this case are they going to let
me see the same interviewer or it is going to only somebody from the
local office.

Thanks

Hi there Kamrooz
I had a huge delay on my background check as well.
I completed all my requirements (biometrics, fingerprints, interview, etc.) back in February 2006. During the interview, the officer advised me that my background check was still pending and to "wait" for a reply for the next "few months".

So I waited...and waited...and still nothing. I also sent a few letters of inquiry to USCIS (addressed to the officer who interviewed me); she never replied. By May, I contacted my congressman and senator to ask for assistance. At the same time, I scheduled an Infopass appt to find out the status of my AOS.

My congresman's sent in the inquiry immediately and said that if USCIS did not reply to their inquiry within 30 days; they will make the phone call.

30 days later, I still haven't heard back from the congressman's office so I emailed and faxed them. They made the phone call to USCIS that same day and APPARENTLY the reason why there was a delay was that someone had forgotten to enter my "Country of Birth" info...so the background check was never processed through the system.

I provided my Country of Birth to my contact at the congressman's office... they in turn forwarded the info to USCIS and the next day I got notification from USCIS that my AOS has been approved and a welcome letter sent.

I would suggest that you contact your congressman and senator immediately and emphasize the urgency of your DV application. Make sure to have everything in writing... just in case. When you go for your infopass appt... make sure you get an answer... if not, politely ask for a reason why.

Good luck to you!
