Is Labor Cert application an Immigration petition ??

Guys,
I am going for Visa stamping. In the form DS-156 the question is 'Has anybody filed an immigration petition on your behalf'.
My labor is pending in the PBEC, what should I answer in that section ?

Immigration petition is I140 and is not your Labor. If any employer has filed I140, then you need say "Yes"

What should one write in the column 'Have you ever been in the U.S. ' , 'when'

For this question, if you have ever been in the US, Inidicate all the date ranges you have been here excluding the time you were out of the US if any.
