hi there!

went through the immigration forum and found your replies well formed and instructive.

I need an advise too.

I have a multiple visit visa to USA and on my next visit my brother who is the USA citizen wants to apply for my immigration.

I wanted to know if , that will allow me to stay in the USA until i receive my immigration or will i have to leave in 6 months as per the visit visa rule.

(An aunt of my relative has a similar case. her sis applied for her immigration while she was visiting USA . she rcvd the letter of acknowledgement that that application has been rcvd and that if she leave the USA she may not be allowed to re enter until she finally gets the immigration. so she is stayed back and is now in US for more than two years. ) She said no clause is mentioned that you have to leave the USA within a certain time and thus its not illegal.)

Can i know if its is possible and there is nothing illegal abt it.

You will have to leave in 6 months otherwise you will be out of status.

You come under Family based 4th preference and your immigration process will take several years since you come under annual quota of 65000 per year. Those who applied under this category in 1998 are still waiting.
 
If the aunt stayed past the date of her I-94, she is in the US illegally and subject to deportation. She is acting very irresponsibly.
