Is it true that the NSC is processing I140s based on the labor priority dates?

I dont if this is true, but I have been seeing cases approved based on the priority date seniority.
Expert advice needed.

No rule, no logic , no sanity , no priority is what NSC follows when it comes to processing anything. This whole process or the lack of it is beyond the capabilities of a human brain to understand. So don't worry and continue to hope that the Sun will rise in the west one day.

I agree with Arvind. This waiting is the worst Labor Pain of its kind.

Keep your sanity with this phrase in mind, "There is no gain without pain."

Labor pain may not be the correct analogy in this case as that only lasts for a few months in comparision to this never ending waiting game.

What adds more salt to the wound is the processing time of I140 in other centers, especially Texas. They are processing applications filed as recently as Jan 2005. This is a three year difference which doesn't justify anything.
 
When I spoke with an INS officer last week, I was told I-140 / 485 is approved based on the priority date. This was in response to my question as how does some of the cases filed after me got approved.

I-140 / I-485 : RD : 04/22/04
FP : 09/03/04 LUD : 09/09/04 Message : "results of your fingerprint….."
EAD/AP : RD : 04/22/04
AD : 06/16/04

Renewal : EAD / AP:
RD : 02/15/05
EAD AD : 03/29/05
 
The last updated message of my 485 had the message "results of your fingerprint has been reviewed and the process has resumed on your case". I checked with my attorney and they said that indicates the results has been given back to the service center for further process.

You can also check with the USCIS at 800-375 5283, option 1,2,6,1 and after you give the receipt number, press 3.

304 625 2000 is the number for fbi finger print status .. call this number they will give you the stats.,

I haven't got my AP approved yet. Valcris had his I-140 approved on 5th april and he thought the 2nd EAD renewal may have triggerred his 140 approval. So, keep your fingers crossed as I would guess the 140 may be approved by Mid or End of May.

My I-40 and I-485 were approved a week back. I spoke to a cool immigration officer at that time. He explained that they are trying to approve I-140's based on priority date. He also said that they approve the I-485 at the time of I-140 approval if the case is ready for adjudication and if a visa number is available.

He also said that some I-140's may get expedited or delayed as they have various queues that are not necessarily FIFO. I guess some officers are specialists in I-140 or I-485 and their queues are a lot faster.

Thanks for the update and congratulations to you on your approval. If they are really going to process on PDs then I will be having more benefit than others as my PD is Dec2001. I know there are lots of people who are waiting longer than me.. but still I can be ahead of people who applied labor after 2002. Lets see how it goes. Keeping my fingers crossed.

I hope they look at mine soon and give me both approvals.. ! I am so tired of waiting.. It feels especially long considering my PD.
