My PD is 1/14/2002, EB3, India. Applied for 485 in Dec 2004. Is it safe to use AC21 and change the job at this point? Will this in any way delay or impact my 485 approval? Please help.

Thanks!

If you meet the requirements of using AC21, you should not be worried at
ALL. Make sure that your I140 is approved, your I485 petition is atleast 180 days old, your new job title is either the same or better than your current
job, job responsibilities in the new job is either similar or better etc.

Keep the paystubs, letter of experience from your current company, and
on top of all, consult a good attorney to keep the paperwork straight.

One of my friends - without not much of homework - used AC21 and moved on to another job. He moved to a new job sometime during 2003 and by Aug 2004 he got his GC approval with NO interview. He was lucky.

One case is and cannot be a good sample but at the same time, it is worth the risk taking as the law permits you to do so as long as you fullful all the requirements.

Good luck

I would say it's realtively safe to use AC21..... there is one little risk of 485 temporary denial....if I140 is revoked by employer

Case 1: 485 gets approved without any hitches

Case 2: 485 gets denied temporarily if I140 is revoked and then you file MOTR to re-open your I485, it may take 1-2 months for the MOTR to get accepted and your I485 reinstated..

Overall, there is a slight risk of temporary 485 denial for 1-2 months (if I-140 is revoked by employer), I guess! Other than that, it's pretty safe...

That's what I observed from my analysis of AC21...
