My priority date is EB2 June 2004 – India, my labor certificate is get approved I am on 7th year H1b Extension and thinking for Consular Processing at US Consulate Canada.

With above situation and current retrogression it is worth to pay 1000 US $ and file I-140 through premium processing? As employer is not going to pay this 1000 $ and I have pay from my pocket.

Appreciate your reply to help me make correct decision.

Thank you,

Re: I-140 premium

I don't think it's practical to file for Eb-2 premium for you. Eb2 I-140 is taking around 6 months. No *new* law to improve retrogression is going to come in 1-2 months. All laws have an *application* time, until then you can't make use of the law.

Moreover, you can always convert a non-premium application to a premium one at a later
stage. Check with your lawyers on extra fees and stuff. I would rather save the $$ and
spend them later if things change drastically.

my 2 cents.

I-140 for 3 yr extension

Premium processing will be beneficial for you if your 7th yr H1 is expiring in couple of months and you want to use the approve I-140 for 3 yr extension.

It is always worth to file in premium processing. Following reasons:

1. It gives you peace of mind and don't have to worry for next 6-7 months.
2. After 6 months of your I-140 approval, you can join another company get a labor and I-140 from there and still can use your old I-140 priority date to file 485 even if your old employer revokes your I-140.
3. It builds little pressure on your employer and reduces level of exploitation.
4. Anytime law changes and visa dates become current, you can file your 485. It is heard that they are going to stop simultaneous filing of 140 and 485.

My 2 cents.

Dear Friend
Thank you, for your advise, I paid 1000 US$ for premium processing, my I-140 approved and PD is getting closer, you help me to take right decision.

Can you please inform me how to get a PCC from Saudi Arabia?

I am going to select CP at Montreal, I need to get a PCC from Saudi Arabia, and Saudi Consulate doesn’t issue PCC without written letter from NVC or Consulate.

Normally what is the time limit to submit all docs to NVC? Is there any other way to get PCC from Saudi Arabia?

Thank you,

Parth

Guys, can someone clarify about PCC?
- Is it needed for 485 or for consular processing only?
- Also, I do not have birth certificate, only affidavits from Mom and Dad. Is it mandatory to get a letter from municiplaity/authority in India that BC was not available?
Thanks.
