My question, is it possible for him to apply in the University here in the US for his PhD? Will be possible to get a student visa, while Immigration petition still pending? Thanks.

It is almost impossible to get a non-immigrant visa (in this case - student visa) while you have an immigration petition pending, which shows obvious immigration intent. Hi:
Yes, there is nothing that prevents him from applying. But he would have to convince the consular officer that he is not using the student visa for other purposes ----- sometimes very hard to do.
