Is it possible to prepare PERM docs within 70 days?

For company A, 1/31/2006 EB-2 PERM filed (converted from RIR).. still "IN PROCESS". H1B 7th year extension is approved until 11/28/2007

Now, I got the offer from company B. Is it OK to move to company B? Company B wants me to start 9/18/2006. I am worried because it would be too short time to file the new PERM by 11/27/2006. The reason why I need to file new PERM by 11/27/2006 is to be able to file 8th year H1B extension with pending/approved PERM > 1 year.
How long it will take to prepare the PERM documents (all papers and ads)?

My current company situation is getting worse so I better to move to company B, only if there is no visa issue. I searched all threads. Someone say it would take 3 to 4 months. Is is possible to prepare PERM docs within 70 days?

As far I know (based on what my company did for my PERM app), for PERM your company has to advertise for recruitment for 30 days in 2 to 3 different ways (eg. website, newspaper, professional magazine, america's job bank etc..). Then you have to wait for 30 days after the recruiment is over. Once 30days are over your attorney can file your perm application. If you have good attorney and he/she understands your situation I don't see why it can't be done in 70 days.


Having said this I would like to advise that please talk to a immigration attorney to get the correct/accurate information as I am not one. What ever you do act immediately without any further delays as tomorrow morning you will have only 69 days left. The clock is ticking

Thanks huge!!! I think you are right based on other threads. It is really helpful information to me at my current critical timing. I will receive the written offer by this Friday and make decision by following Monday.

It is totally possible.

I got an interview 2nd week of June and got accepted. I was gonna enter 6th year in september.

The company hired an immigration attorney first week of july. He made everything ready in 65 days and we filed 2 weeks ago under PERM.

It is technically possible, but I dont know the result yet. If I get approved, I`ll update but it might be too late for you.

It's absolutely possible. Technically, if you had everything you needed right at the start, it could be filed in 60.
 
its possible but you need to have a very cooperative employer, preferably one who has experienced labor certification before. you would also need a lawyer who is capable of moving on your case on expedited basis. the lawyer would need to move quickly on obtaining the prevailing wage, your employer (who will work in conjuction with your attorney) would need to be diligent in getting all the recruitment done , and then, prior to filing, you would need to wait for 30 days after the swa advert has been filed.

so 70 days is tight but doable...mine was done in about 80 days (i think) and i had to push everyone really hard.
 
After one gets the prevailing wage determination, the minimum time in which one can file PERM is 61 days. (30 days recruitment + 30 day "quiet" period after which PERM can be filed on the 61st day)
