My first I-485 was filed on 6/02, based on
approved I-140 and labor cert.

Now I got another I-140 approved based on EB1-EA.

I am wondering if anything I can do to take advantage
of the second-140 approval.

Any suggestions are appricaited. Thanks!

Hello:

Can you shed some light on your qualifications that helped you get a EB1-EA. i am looking to apply in the same category. I have a NIW-EB2 I-140 approved currently but i am looking at the EB-1 category too. please respond.

Gkhan.

Why do you want to apply for another

if you already have a NIW approved. This is the best one for job flexibility, isnt it.

EA is even better. NIW requires you to prove that you are still working in the national interest area (after changing a job). In the case of EA, it only requires you to work in the same occupational category you are approved for.

correct me if I am wrong

logicators..
but NIW doesnt even require a job offer. so one could technically stay at home/be unemployed at the time of approval or interview.
Of course the best thing would be to work and keep working in the area one was approved for.

EA does not require a job offer either. My own EA and NIW were approved within a week of each other. My attorney did not hesitate to go ahead with the EA stating specifically that it was better than NIW.

My take on this is

that most people consider NIW as working in national interest area. Its not like that. Its waiver of the labor cert. which inherently is of national interest. hence the term NIW.
It also means waiver of job offer requirement. Hence no ongoing job is reqd (although its best to have one).
I have not done EA, so I cannot comment on it. Suryasaha, you have OR and NIW approved, so you might know more about EA/OR (as you might have looked at both).
For an NIW, your work needs to have substantial intrinsic merit, be national in scope and the all important ---your background and your importance that can allow the waiver of job offer and also supersede requirement of LC.
e.g: since you are a geneticist, if you work on chromosomal alterations having implications towards trisomies and then you leave job and work elsewhere on chromosomal alterations or dysjunctions etc again..then you are good. Thus you only need to work in your area of expertise. this is what I got from this and murthy forum.

my qualification

Graduated from Computer Engineering in 2000.
Working for a startup for 3 years now.
3 book chapters
4 Journal papers (two in the top journals in my field).
several conference papers.
I am the first author of all papers.
1 patent.
reviewer and committee member for several journals and conferences.
about 10 citations.
5 reference letters

Waited for more than a year. Got an RFE for almost everything,
even high salary which I did not claim, especially letter from
employer. Submitted 5 more reference letters from the top
researchers in my field and 40+ citations.
Got approval within 3 weeks.

This is pretty much it. Since my labor-based I-140 was approved
June last year, I was always hesitating if it is necessary to finish
this one. Sometimes the outcome could be out of your
expectation if you were not expecting too much. As you know
now I cannot do much with this approved EB11 except locking
it in a safety box.

This forum has been very very helpful for me during this long journey, especially several comments/experiences posted several months ago, such as how to get refenrece letters from someone I have never met.

Hope this helps.
