Is it possible to file 140 when the beneficiary is not in US

Hi -

The RIR was approved after a wait for 3 years and 10 months.
Is it possible and safe, to file 140 when the beneficiary is in INDIA.
Advise on this please.

Sure. The person is in US or not has nothing to do with I-140 filing. After I-140 approval, person can apply for CP when Priority Date is current. Other option is to enter in US on H1/L1 visa and apply for I-485.
